The personal information that you provide to Vip2phone through the Service is governed by this Policy. You are responsible for maintaining the confidentiality of your username, password, and other confidential information. For the purposes of this Policy, personal data refers to any information related to an identified or identifiable person (hereinafter, "Personal Data").
The privacy and security of your personal information are and always will be of fundamental importance to Vip2phone. Therefore, we want to explain to you in a transparent way the controls and options available to you in terms of how and when you share your personal information. By accepting Vip2phone's terms and conditions, you understand that we will collect and process your personal information as described in this Policy. All terms used in initial capital letters that are not defined in this Policy will have the same meaning as that assigned to them in the terms and conditions.

INFORMATION WE COLLECT
Information that our customers provide to us when subscribing to our service platform for use of our services, information gathered when you request that the company contact you, information provided to us during communications with the company and its customers. The company may request personal identifying information such as your name, birthdate, postal address, e-mail address, telephone number, the name of your company, job title, and information related to payment. Should you request support services from the company, we collect additional information from you, including but not limited to: contact information, documentation, screenshots, and/or any and all additional information that assist us to resolve the matter for which support services were requested. Calls to VIP2Phone customer service and sales representatives may be recorded by the company for quality assurance, training and research purposes.
VIP2Phone collects customer information at various points on the website (through online forms, cookies, log files, and clear gifs), over the phone, and through fax transmissions (conversations with customer service and forms submitted by fax/mail) and through the use of the VIP2Phone service (creation of call records, contact information associated with a corporate customer account, call logs ( call logs), voice and data transmissions, IP address and the type of web browser used). We only collect the information we really need. You may choose not to provide certain information, however, if you do so, you will not be able to enjoy many of the functions that Vip2phone offers you.
We collect billing and payment information when you register for paid products or services. For example, we might ask for a billing address or contact for the Vip2phone account. If you provide us with this information, we will use it only as authorized by you under this Policy. You may also provide payment information, such as bank account or data of credit card numbers, when You purchase Services. We use third-party payment service providers to manage payment processing.
- Information through third parties:
Information may be obtained through third-party sources if you create an account or access our services or website through a third-party service or social media platform, including but not limited to Twitter, Linkedin, Facebook, GitHub, Google, or utilize a social media feature in tandem with our services, any and all information such as personal data from the third-party social media source may be shared with the company. Such information may be used by the company to market and enhance services the company provides, and to personalize the service provided to our customers. We may also collect information from other third-party services that may be integrated with our services or applications that the customer authorized to interact with, connect to, or synchronize with the services provided by the company. It is the customer’s responsibility to exercise control of his/her social media accounts data sharing options.
- Information about the account holders’ customers.
Our account holders and other third-parties may provide the company with personal information about our account holders’ users and others. Such information received by the company may include, but is not limited to information from our account holders, senders of messages, mobile network operators, various databases which may provide information that is relevant to providing telephone numbers, and other third-parties. Such information may include, but is not limited to: telephone numbers, type of telecommunication service (e.g. landline or mobile), device status information, roaming status, carrier, location, and information related to any porting of numbers.
- Usage Information:
We collect information related to how you use the Services. We may also record, analyze and use your interactions with Vip2phone, including email, phone and chat conversations with our sales and customer service professionals, to improve our interactions with you and other Customers. Usage Information, in some circumstances, may be a type of personal data and consists of information passively provided or automatically generated during your use of the Service, including the number of calls, duration of calls, time and duration of usage, identifiers showing the source and destination of communications, IP addresses, location and overall usage amounts and content of communications such as calls, voice mail and/or recording services, messages, numbers called, and the call content, etcetera. Usage Information may include call detail record ("CDR") information and other customer and end-user call records. We use this information to provide, improve and promote our Services, to manage the content of communications provided in tandem with the use of our service and to protect Vip2phone users.
- Use of Mobile Applications.
The account holder’s use of our mobile applications may entitle that we access and store the user’s contact list and address book whether the mobile application is used with a mobile phone, tablet or other broadband device. This information is necessary to ensure that the services associated with the use of our applications are available to you and also to facilitate and enhance the services provided to you. We may also require access to the camera, microphone and photos of a mobile device for the use and delivery of voice calls, video calls, messaging and transmissions of photographs via our service. Additional information regarding location is necessary if the mobile device utilizes GPS and accesses hot spots, cell towers and/or satellites.
- Device Information:
We also collect information from the devices You use to access the Services and information about those devices. This includes IP addresses, the type of browser and device you use, the web page you visit before accessing our sites, and identifiers associated with your devices. Devices may (depending on settings) also transmit information about your location to the Services. For example, we use device information to detect abuse and identify and fix bugs. We collect information that web browsers, mobile devices and servers make available, such as language preference, device operation system version, firmware, device and network configuration, device identifier, browser information, IP address, mobile or wireless network data and information, time zone, referring URL, date and time of access, operating system, device manufacturer mobile phone and mobile network information. We include them in our log files to understand more about visitors to our websites.
- Information gathered when visiting our company website.
The company, and any affiliates, contractors, agents or third-party partners, including but not limited to advertising and analytics collaborators, regardless of how said collaborator(s) is related to the company, collect information about all visits to our website and interactions with ads and/or content appearing on our website platform, along with other information such as, the user and/or customer’s IP address. We may obtain information from credit reporting agencies for the purpose of assessing and controlling risk to the company related to establishing new accounts and for collection purposes.

You are under no legal or contractual obligation to provide Personal Data to Vip2phone. However, if you do not provide certain information, we may not be able to enter into a business agreement with you or process your support request.
RETENTION OF PERSONAL INFORMATION
Regarding the retention period of your data, it will be consistent with the original purpose for which it was collected. The time during which Vip2phone keeps the information that is collected depends on the type of information, the services provided and the mechanisms used to collect and store it. Where Vip2phone is the data controller of Personal Data (for example, personal data relating to Website visitors, attendees, and people who register to use our Services), it retains the Personal Data that is collected when there is a need legitimate and ongoing business to do so (for example, to provide you with our Services, to enable your participation in an event, and to comply with applicable legal, tax, or accounting requirements).
When collected information is no longer utilized, the company will either anonymize, delete or securely store the collected information in backup archies until deletion is feasible. HOW WE SHARE THE INFORMATION WE COLLECT
Third Party Service Providers:
We share information, including Personal Data, with our third-party service providers that we use to provide hosting and maintenance for our Websites, application development, backup, storage, payment processing, analytics, and other services for us. These third-party service providers may have access to or process your Personal Data for the purpose of performing these services for us. We may collect and contract with third-party analytics providers to compile metrics and information regarding your use of the Service, including evaluating how Customers use the Service (“Usage Data”), to develop new features, improve current features or inform sales and marketing strategies, based on our legitimate interest in improving the Services. These providers are prohibited from using Personal Data for any purpose other than these and are obligated to protect the confidentiality of your information.
Vip2phone is provides a communications platform which requires the sharing of collected information and data with other communications providers including but not limited to traditional telecommunications providers as may be necessary to provide services to account holders. The third parties that we share information with include but are not limited to business operations vendors that provide: website and applications development, hosting, storage and backup functions, payment processing and virtual infrastructure providers. In addition, certain information related to your account, such as your phone number, may be shared with senders and recipients of communications depending on the services used by the account holder. The service provided relies on the use of the internet and therefore no guarantee that collected information will be 100% safe is made. The customer expressly acknowledges, understands and agrees that the company shall not be responsible for any security breach related to information collected that arises from use of the internet and the conduct of third parties and further agrees to indemnify and hold Vip2phone and any of its partners, agents, affiliates or contractors harmless from all liability that might arise related to the security of collected information. The customer acknowledges and accepts the risk that third parties may gain unauthorized access to information that is provided through the use of the platform and/or services. The customer recognizes that the use of the company’s service for sending and receiving information and communicating internationally requires the sharing of information with foreign entities and in foreign jurisdictions that may not have privacy laws that are similar to those of the United States. By using the company’s services, the account holder authorizes the transfer of its information within and to the United States where the company is based and information is stored. If the company’s services are used to communicate internationally, the account holder authorizes the transfer of its information to foreign jurisdictions with the assurance that the company will make all reasonable efforts to safeguard account holders information. However, it is sole the responsibility of the account holder to safeguard the secrecy and privacy of its user credentials which includes user name and password(s).
Employees and Independent Contractors:
Certain Vip2phone employees and independent contractors have access to personal information when they need it. We require all employees and independent contractors of Vip2phone entities to follow this Policy for personal information that we share with them.
Law Enforcement and Law Enforcement Requests:
In certain situations, we may be required to disclose Personal Data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. We may disclose Personal Data to respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. We may also share such information if we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our terms and conditions, or as otherwise required by law.
VIP2Phone acts as a passive conduit for the distribution and receipt of your voice and data transmissions and does not monitor or disclose the content of a customer's communications unless required to do so by law or in the good faith belief that such action is necessary to : (1) comply with the edicts of the law or comply with legal process served on VIP2Phone; (2) protect and defend the rights or property of VIP2Phone; or (3) act under exigent circumstances to protect the personal safety of its clients or the public.
Information Sharing with Affiliates:
We may share information, including Personal Data, with any affiliate of Vip2phone, and they will use that information only for the purposes already described in this Policy.
In connection with a reorganization, restructuring, merger or sale, or any other transfer of assets, we reserve the right to transfer any information we hold about you. The collected information may be used to protect the legal rights of the company, the interests and rights of others, for purposes of compliance, the processing of claims, audit and regulatory functions, and necessary legal disclosures in the event of any merger, acquisition, or sale of the company or business relationship with third parties, agents, partners or affiliates regardless of type and duration of the relationship between the company and other entities.

VIP2Phone may also use customer information to investigate and help prevent potentially illegal activities or activities that threaten the network or violate the customer agreement for that service. While VIP2Phone cannot be responsible for the content, dialing or transmission patterns, or abuse of the service by and by its customers or those sending transmissions to its customers, it is our intent to use legally available means to prevent the use of the services for any unlawful purpose, including, without limitation, the distribution and receipt of unsolicited commercial faxes ("Junk Faxes") and harassing phone calls.
Resale of services is expressly prohibited. You understand and agree that the service(s) provided by the company are personal to you and you expressly agree not to resell the use of the service to any person or entity.
